Broadcast of the meeting

 

The Chair to announce the following: ‘In addition to the rights by law that the public and press have to record this meeting, I would like to remind everyone that this meeting is being broadcast live by the Council to the Internet and can be viewed on our website for six months after the meeting. After that time, webcasts are archived and can be made available upon request.

 

If you have asked to address the meeting, you are deemed to be consenting to having your contributions recorded and broadcast, including video when switched on, and to the use of those sound recordings and images for webcasting and/or training purposes.’

Report of the Executive Director Supporting Communities

 

This is an application for a new premises licence under Section 17 of the Licensing Act 2003.

Consideration was given to a report of the Executive Director Supporting Communities detailing an application for a new premises licence under section 17 of the Licensing Act 2003.

 

The Panel agreed, following the proposed amendment in the application by the Agent, that condition 9, appendix 4 (page 86) ‘Anybody who appears to be under the age of 25 who attempts to enter (unless with a guardian over 18 and having a full table meal being able to prove that they are over 16) or purchase’ be removed.

 

PC Kevin Nichols, Police responsible authority, summarised the main points in their submission and answered questions by clarifying the following:

 

·       The Police responsible authority believed that adding additional businesses of this nature to the area would increase crime and that a ‘needs test’ should be applied.

·       It was confirmed no further data on crime figures or intelligence reports relating to the venue or the area of the venue, in addition to what was within the representation, had been prepared for the hearing. However, specific data could be provided upon request during the hearing.

·       There were no specific complaints related to the licensee and their operation in the last two of years.

 

Paru Bhudia, Licensing Authority responsible authority, summarised the main points in their submission and answered questions by clarifying the following:

 

·       It was confirmed that on two points their written representation was factually incorrect, and the following was clarified:

-       It was incorrect stating that licensable activity was applied between 13:00 to the terminal hour each day (page 82). It could only be applied from 23:00.

-       It was incorrect stating that the applicant had not provided a comprehensive operating schedule (page 85). It was available on Appendix 4 (page 86). It was clarified that instead of forming a basis for refusal, it should have formed a basis to impose conditions.

-       In relation to point 7 of the recommended additional conditions of the Licensing Authority (page 84), it was confirmed thar conditions with a criminal penalty could not be imposed to activity on the public highway.

·       In relation to point 10 of the recommended additional conditions of the Licensing Authority (page 84), it was confirmed that it was not a legal requirement for venues in the area to hire Security Industry Association (SIA) registered door staff. It was stated by the Licensing Authority this was a standard request to all venues of this nature.

·       In relation to the rational of the recommended closing time of midnight, it was confirmed that there had been no assessment on turning out times of the local nigh time economy premises closing hours. Additionally, there was no data to indicate that there were particular problems with other late night refreshment premises in the area which had later closing times.

·       In response to the question why being open between 23:00 and midnight would be cause for particular problems, given there had been no complaints in the past two years with a closing time of 23:00, the rationale was  ...  view the full minutes text for item 7.
