Broadcast of meeting

 

The Chair made the following announcement: "In addition to the rights by law that the public and press have to record this meeting, I would like to remind everyone that this meeting is being recorded and broadcast live by the Council to the Internet and can be viewed on our website for six months after the meeting. After that time, recordings are archived and can be made available upon request.

 

If you have asked to address the meeting, you are deemed to be consenting to having your contributions recorded and broadcast, including video when switched on, and to the use of those sound recordings and images for webcasting and/or training purposes.”

Consideration was given to a report of the Executive Director, Supporting Communities detailing an application for a new premises licence under Section 17 of the Licensing Act 2003 and to information circulated in the supplementary agenda.

 

The Licensing Officer introduced the report and explained that conditions had been agreed between the Applicant and the Police and Environmental Health Responsible Authorities. Two local residents had also withdrawn their representations and agreed conditions. He added that there was a question on the application form on the council’s website about the number of people expected to attend the premises, which was listed as “under 5000” and it was not possible for applicants to amend or delete the question, but he confirmed that the actual capacity of the premises was 60.

 

The hours requested were within framework hours, but the application was also requesting seasonal variations for the nights before Bank Holidays and for New Year’s Eve and New Year’s Day.

 

The Applicant’s Representative, Richard Marshall-Duffield, clarified that the start time requested in the application for opening hours was 7am on each day of the week, not 8am for Monday-Saturday as written in the report. He had no amendments to the application.

 

Councillor Linda Chung addressed the Panel as an Interested Party and made the following points in her submission:

 

·       The street is highly residential.

·       She wanted clear signage with a named person and contact details for people to contact if they have concerns about the operation of the premises.

·       She wanted the Applicant to clearly indicate loading bays for delivery bikes and to indicate that they are one-way systems.

·       A-boards cluttered the street, particularly given the narrow pavements, and she wanted the premises’ A-board removed.

 

Councillor Sark made the following points in his submission:

·       The premises was currently a quiet coffee shop but he was concerned it could become more like a nightclub if there were ticketed events with live entertainment and a sound system.

·       There had been numerous reports of anti-social behaviour from a sports bar known as Tinseltown four years ago, and he wanted to ensure that similar issues would not recur at this premises.

·       There did not appear to be any controls over people smoking outside, which would be in front of people’s front doors.

·       He was concerned about noise and public nuisance, especially if people were queuing outside for a ticketed event or there was a major football match being shown.

·       The premises was asking to open at 7am but other premises in the area only opened at 8am.

·       He asked that there be quarterly meetings between the management of the premises, residents and councillors.

 

Questions were asked of Councillor Stark by the Applicant’s Representative as to whether the objection was to a sports bar, as they had no intention of operating the premises as one. Councillor Stark replied that he was objecting to any premises that would increase public nuisance in the area. Local Government Act 1972 - Access to Information

Should the Panel wish to go into closed session, it will take the following resolution:

 

THAT the press and public be excluded from the proceedings of the Licensing Panel on 13th July 2023 during consideration of the respective item on the agenda on the grounds that it is likely, in view of the nature of the business to be transacted, that were members of the public to be present, there would be disclosure of exempt information as defined in Schedule 12A to the Local Government Act 1972 (as amended) and that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

 

Specifically -

 

Publicity in respect of item x would be likely to lead to the disclosure of information in respect of which a claim to legal professional privilege could be maintained in legal proceedings by virtue of Category 5 of Schedule 12A of the Local Government Act 1972 (as amended).
