Announcements (if any) Minutes: Broadcast of the meeting The Chair made the following announcement: ‘In addition to the rights by law that the public and press have to record this meeting, I would like to remind everyone that this meeting is being broadcast live by the Council to the Internet and can be viewed on our website for six months after the meeting. After that time, webcasts are archived and can be made available on DVD upon request.
If you have asked to address the meeting, you are deemed to be consenting to having your contributions recorded and broadcast, including video when switched on, and to the use of those sound recordings and images for webcasting and/or training purposes.’
Order of Business The Chair proposed and it was agreed that agenda item 6 “Minutes” would be taken after item 8. The remaining items were considered in the order in which they appeared on the agenda.
Supplemental agenda It was noted that a supplemental agenda had been published on 27th September regarding Item 7 “Gaucho Grill”, which included responses from the applicant to the interested parties in respect of the issues they had raised in their submissions which were omitted from the agenda. The papers were received by the required deadline.
Item 10 - P M Cash & Carry Ltd, Unit 3405 Belgrove House, Belgrove Street, London WC1H 8AA It was noted that this application had now been resolved as the Police and Licensing Authority responsible authorities had agreed times and conditions with the applicant.

Gaucho Grill, 58-62 Charlotte Street, London W1T 2NU Report of the Executive Director Supporting Communities
This is an application for a Shadow premises licence under section 16 of the Licensing Act 2003. Additional documents: Minutes: Consideration was given to a report of the Executive Director Supporting Communities detailing an application for a shadow premises licence under section 16 of the Licensing Act 2003.
It was noted that following representations from the Licensing Authority responsible authority, the application had been amended to include conditions agreed with the Licensing authority, which related to shadow licences. On the basis that the agreed conditions are included in the application the Licensing Authority withdrew their representation. The agreed conditions contained in Appendix 5 on page 137 of the agenda.
The Panel noted that a supplemental agenda was circulated on 27th September 2021, which included responses from the applicant to the interested parties in respect of the issues they had raised in their submissions which had been omitted from the agenda. The papers were received by the required deadline.
In response to questions from the interest parties, the Licensing Officer confirmed that the premises licence was not due to expire this autumn, once granted it would be there for life. Also one of the conditions agreed with the Licensing Authority related to holding quarterly meetings with the licence holder, but it was noted that the current licence holder had been evicted from the building and the premises were empty. The Licensing Officer replied that in those circumstances the licence would be transferred to the person who would be operating the premises in the future. The shadow licence, if granted, would be held by the freeholder.
Three representations had been received, one from Linus Rees on behalf of the Charlotte Street Association and two from local residents, Guy O’Connell and Stefan Nardi Hiebl.
The Chair confirmed that all the representations submitted by the interested parties not in attendance would be taken into account when reaching a decision.
Linus Rees said that he was also speaking on behalf of Stefan Hiebl who was unable to attend the meeting. He summarised the main points in both submissions as follows: - The current licence holder had been evicted and the premises were empty. - The applicant wanted to obtain this new licence to transfer it at a later date to a third party operator, they would not use the licence themselves. - He referred to his letter on pages 123-126 of the agenda. Camden’s Policy encouraged operators to discuss licences with local residents and anyone else who might submit representations. However, there had been no opportunity to discuss the application with the operator as there was no operator despite it being a new application. - The premises were surrounded by a large number of residential properties on Tottenham Street, Charlotte Street and Scala Street and he was concerned about any nuisance arising from the operation of the premises. - He had asked for a restriction on hours for licensable activities to cease at 23:00 Monday to Saturday and 22:30 on Sunday. - He had also asked for a number of conditions relating to public safety including the “Ask Angela” scheme, and prevention of ... view the full minutes text for item 7. |

Kilimanjaro Live, Kenwood House, Hampstead Lane NW3 7JR Report of the Executive Director Supporting Communities
This is an application for a new premises licence under section 17 of the Licensing Act 2003.
Additional documents: Minutes: Consideration was given to a report of the Executive Director Supporting Communities detailing an application for a new premises licence under section 17 of the Licensing Act 2003.
It was noted that following representations from the Police responsible authority, the application had been amended to include conditions agreed with the Police. On the basis that the agreed conditions are included in the application the Police had withdrawn their representation. The agreed conditions were contained in Appendix 4 on pages 178-179 of the agenda.
The Panel noted that one relevant representation opposing the application has been received from a local resident, Mr R Owens, as set out on pages 173-176 of the agenda. Mr Owens was not in attendance at the meeting and the Panel confirmed that his representations would be taken into account when reaching a decision.
Kingston Myles, Head of Commercial Development, English Heritage summarised the application on behalf of the applicant as follows: - The light trail would follow a 1.4km route consisting of visually stimulating, fire, light and sound installations within the historic grounds of Kenwood House Estate. - The illuminations would not be projected into the sky but would be focused around Kenwood House, the trees and surrounding area. - There would be a Christmas Market consisting of up to 10 food units and craft stalls and 2 bars, which would predominantly be selling Christmas themed beverages, bench seating and a carousel. There would be a further 2 bars on the trail itself as well as a VIP bar offering. - The route was fully accessible as it used the permanent pathways within the grounds itself. - A detailed event programme was available.
Decision and Reasons
Panel Members confirmed that they had been able to follow and understand the submissions and discussion in relation to this application.
In deliberation, Panel Members noted that the Police had withdrawn their representations following the inclusion of conditions to the application. There had been no representations received from the Environmental Heath responsible authority regard light pollution.
On this basis, the Panel agreed that granting the application with conditions would uphold the licensing objective of the Prevention of Public Nuisance.
RESOLVED –
THAT the application for a Temporary immersive Christmas themed visitor attraction and Market in the Public Gardens at Kenwood House be granted with conditions for a limited time period from Thursday, 25th November 2021 until Monday, 10th January 2022 as follows:
a) Supply of Alcohol (For consumption on the premises) 11:00 – 23:30 Monday to Saturday 11:00 – 22:30 Sunday
b) Recorded Music 11:00 – 23:30 Monday to Thursday 11:00 – 22:30 Sunday
c) Late night refreshment 23:00 – 23:30 Monday to Saturday
d) Opening hours 11:00 – 23:30 Monday to Saturday 11:00 – 22:30 Sunday
